“third party” means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

 

“consent” of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

 

Personal data is only processed by our company in accordance to the data protection regulations in force. In case you correspond with our company or fill in a form with your data, you accept that the data is processed for the mentioned purpose.

3. Processing personal data

Personal data is processed for mentioned purposes only. Your personal data is not transferred to third parties, with exception for those applications mentioned in this data protection declaration or binding national law.

 

On our website we offer you the opportunity to contact us, either by email and/or by using a contact form. Personal data provided by the user is only stored for the purpose of facilitating communications with the user. We will ask you to give us your consent beforehand and provide information via a hyperlink.

 

a) Online shop and user-registration
You can order without registration or creating a user account. The user account can be delet-ed at any time. Data, which was announced to our company in accordance with your order in the online shop are necessary for the transaction of the contract such as for the reason of a future customer service. These data is processed and used by our company for that reason only.

 

By sending an order form without registration or creating a user account your personal data (title, name, address, telephone number, e-mail address) is processed for the purpose to perform a contract with you.

MPAY24 services of the company mPAY24 GmbH, Grüngasse 16, 1050 Vienna, are used to process purchase transactions. A data processing agreement has been entered into with mPAY24. The data disclosed in the order placement is passed to the online retailer, which has been purchased from, and payment system operators, where the payment is carried out. The payment settlement is performed by payment system operators (banks and credit card organizations) who are authorized to carry out the respective payment procedure and undertake to structure its services in an as secure manner as possible. Data transfer serves to carry out payments remotely and to enable the use of mPAY24.

 

MPAY24 does not pass on data to third parties unless mPAY24 is legally obliged to do so or a transfer of the data is necessary in order to take legal action against fraudulent access.

 

b) Newsletter
Our website offers the possibility to subscribe to our newsletter. This can be done during registration with your explicit approval or by disclosure of your e-mail address. The personal data (title, name, country of origin, e-mail address) collected will only be used to receive our news-letter. In addition we kindly ask you to confirm that you are owner of the e-mail address such as your agreement for receiving the newsletter. Purpose of the data processing is supply of information concerning products, services and events.

 

c) Lottery
Lotteries are organized on our web site at times. Participation does not require a user account. Your data is only used within the lottery, except something else was agreed in the conditions of participation.

When subscribing to our lottery your personal data (title, name, address, telephone number, e-mail address) is processed. Purpose of the process is participating in the lottery.

 

d) Product registration
Our website offers the possibility to register your product in order to receive a free mainte-nance and repair service reminder.

Upon registration of the BWT product, your personal data (title, name, address, telephone number, e-mail address) will be processed. The purpose of data processing is to supply in-formation about products and services. We use technical and organizational security measures to protect your data against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. The transmission of your data on the internet is encrypted. Our security measures are regularly reviewed and revised in line with technological developments. Purpose of the data processing is supply of information concerning products and services.

 

e) Contact via our website

On our website we offer you the opportunity to contact us by contact form. In such event, information provided by you (name, address, telephone number, FAX, e-mail address) is stored for the purpose of facilitating communications with the user.

 

Purpose of the process is the handling of your request.

 

f) Find an installer
On our website we offer you the opportunity to contact a BWT drinking water professional or BWT partner installer. The personal data provided by you (title, name, address, telephone number, e-mail address) is processed and transmitted to the installer you chose. A copy of the message is sent to the BWT Aktiengesellschaft.

Purpose of the process is the handling of pre-contractual procedures.

 

g) Job portal
Personal data, which is provided by online application, will be kept confidential. These data will be used only for the execution of the application process. As soon you send an online application via the relevant mask you will receive a confirmation e-mail. Your personal data is stored as long as it is necessary for the application process.

For the application process following information is relevant:

 

Salutation, title, first and last name, address, nationality, date of birth, country, and place of birth, telephone number, email address, marital status, possibly completed presence or civil service, information on the desired position.

 

By filling in this form you can apply for positions in our company. For the application pro-cess, the necessary information and personal details, such as name, address, e-mail address or details of nationality and birth dates recorded. You are able to upload individual application documents (such as CV, cover letter, letter of motivation, credentials and photo). The specified information and uploaded documents are added to our job portal and stored there.

 

If you apply for an advertised job via the job portal, your data can only be viewed and processed by the responsible personnel of the personnel department as well as by the responsible employees of the tendering department.

 

With an unsolicited application via our job portal, you provide us with your personal data for the purpose of finding a suitable job. Your data can then be viewed by the personnel departments of BWT and by the employees involved in the application process to check your profile for suitable job offers.

 

In addition, we check whether your application is suitable for other vacancies in Austria, at European locations or subsidiaries of BWT Aktiengesellschaft. In the case of a suitable offer, the specific forwarding of your application data by the responsible personnel department takes place.

 

Applicant data provided in the online application process can be forwarded within BWT in Austria as well as to European locations of Group subsidiaries.

 

Your answers and information provided during the application process will be generally stored with your name up to six months after the application process has been completed. Thereafter, the results are stored only in anonymous form for statistical analysis. This statistic record does not allow any conclusions about your person. When registering for the Job Portal, you may give consent that the information you provide may be kept in evidence. The evidence is held for a period of two years.

 

You have the right to have all your stored personal data rectified or deleted by email at any time.

 

We use technical and organizational security measures to protect your data against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. The trans-mission of your data on the Internet is encrypted. Our security measures are regularly reviewed and revised in line with technological developments. Purpose of the data processing is the processing of your application.

4. Legal basis

Data procession is based on section 96 (3) TKG such as Art 6 (1) lit a, b, c and f GPDR. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case the processing is based on Article 6(1) lit. b GDPR. If our company is subject to a legal obligation by which processing of personal data is required, such as the fulfillment of tax obligations, the processing is based on Art. 6(1) lit. c GDPR. Finally, processing operations could be based on Article 6(1) lit. f GDPR.

5. Storage period

The criteria used to determine the period of storage of personal data is the respective statutory retention period. After expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for the fulfillment of the contract or the initiation of a contract.

6. Rights of the data subject

You may at any time object to the use of your personal data with future effect, arrange a partial or complete deletion or blocking or request information about the personal data stored by us or request its rectification. In case a complete deletion is only possible at a later time because of legal or economic reasons, the data is going to be blocked. Our company is going to inform you immediately if a personal data breach occurred, such as the breach includes a high level of risk for your rights and freedom. You have the right to appeal to the national data protection commission.

 

These rights can be enforced at any time, in writing, to BWT Aktiengesellschaft, office@bwt-group.com Please note that an information can only be provided to you in case of a corresponding evidence of your identity.

 

In case you want to delete your customer account finally, the data stored in your customer account is going to be automatically deleted.

7. Cookies

Many internet sites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a character string through which internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This allows visited internet sites and servers to differentiate the individual browser of the data subject from other internet browsers that contain other cookies. A specific internet browser can be recognized and identified using the unique cookie ID.

a) Anonymous user profile

Within statutory provisions our company creates user profiles under a pseudonym for the reason of promotion, market research and the customization of our services. You can object to the usage of this data at any time with future effect. (Please see section 7).

 

b) Use of Google Maps

This website uses “Google Maps” a component of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA (“Google”). a) etracker

The provider of this website uses the services of etracker GmbH, Hamburg, Germany https://www.etracker.com to analyse usage data. Here, cookies are used which enable the statistical analysis of the use of this website by its visitors as well as the display of usage-relevant content or advertising. Cookies are small text files that are stored by the Internet browser on the user’s device. etracker cookies do not contain any information that could identify a user.

 

The data generated with etracker is processed and stored by etracker solely in Germany by commission of the provider of this website and is thus subject to strict German and European data protection laws and standards. a) Amazon Ads

Within our website, we use the “Amazon Pixel” to present advertisements tailored to individual interests. This website uses plista, an advertising service of plista GmbH, Torstraße 33-35, 10119 Berlin. Personal data is not collected by plista. The anonymous data are stored in your browser by so-called “cookies”. The goal of plista is to provide users with interesting content and ad recommendations. In doing so, plista compares the interests of users and recommends the favorites, like. frequently accessed content of similar users. Interests are expressed in the form of clicks. This means by the example of reading habit that the behavior is recorded and transmitted to the plista server and stored there. This only happens on websites that belong to the plista network. It is not possible for third parties to view or read the data.
